How Does the Overturning of Roe v. Wade Affect Women’s Rights?

In the summer of 2022, the sitting Supreme Court struck down the 1973 ruling of Roe v. Wade, which had established abortion as a federally protected right for women.

The current Supreme Court determined that the Constitution didn’t substantiate abortion as a right to privacy. This ruling handed the authority to restrict or protect abortion back to each state.

What Did the Overturn of Roe v. Wade Mean for Women?

For women in the United States, how this affected them largely depended on their state of residence.

For example, in Minnesota, a woman’s right to abortion is protected by the state constitution. To prevent a woman from having access to abortion would require passing a state amendment.

However, in some states with severe abortion restrictions, exceptions typically include life endangerment to the mother.

How Does This Impact Women’s Healthcare?

The Supreme Court ruling affects only elective abortions. In pregnancy-related conditions, incidents, or emergencies, women should have full access to the medical care they need, regardless of where they live in the United States.

This care includes (but is not limited to) miscarriages, ectopic pregnancies, pre-eclampsia, and more.

In states where abortion is restricted or banned, the laws typically have health provisions that allow exceptions if the pregnancy endangers the mother’s life or physical health.
